Condominiums, Subdivisions & Site Plans
Loopstra Nixon LLP has wide ranging experience implementing developments on behalf of municipalities and developers through plans of subdivision, site plan approvals, and condominiums (and often an intersection of all of these).
We have been responsible for the creation of municipal template agreements for small rural municipalities and large urban centres. Our role often involves the coordination of multiple disciplines, including planning, engineering, heritage, urban design, transportation, environmental and others, to implement workable solutions for well planned development. In some cases this involves multi-party alternative dispute resolution where these matters have been appealed to the Ontario Land Tribunal.
We have represented developers of condominium projects both residential and commercial, from small infill projects of a few units to large multiple phase tower projects. We work closely with our clients from the early stages of a project, along with surveyors, architects, property managers and sales teams, to establish the appropriate legal framework for a project from the outset. We then work with the team through the preparation of all required condominium disclosure documents, Tarion warranty administration, agreements for marketing and sales, the final declaration and by-laws for the creation of the condominium corporation, through to the registrations required for occupancy and final closing, and the final turnover meeting.
We also act for established condominium corporations with continuing matters under the Condominium Act.
