The Bankruptcy, Insolvency & Restructuring team acted for MNP Ltd., as trustee of Cellicon – a national retailer of cell phone accessories and services.  Not only did the Loopstra Nixon team shepherd the successful going-concern sale of the national business but also created new law in the context of a request to transfer bankruptcy proceedings out of designated bankruptcy court.  The BIA contemplates transfers between bankruptcy courts but not to ordinary courts.  The same test should apply and such transfers should be rare.
