Loopstra Nixon Partner Michael McWilliams represented two doctors in a six-person nephrology partnership who discovered that other members of the partnership owned a separate corporation that operated a nephropathy clinic and received funding that our clients believed should be shared with the original partnership. The dispute was complicated by counterclaims amongst the partners, who also continued to work together in the same hospital unit.

Michael was successful in negotiating a settlement agreement with two of the defendant doctors, and at trial against the other two doctors, the counterclaim was dismissed and our clients were awarded $310,000 in compensation including a rare punitive damages award of $100,000 and more than $700,000 in costs. The defendants’ appeal to the Ontario Court of Appeal was dismissed, with a further $25,000 in costs awarded to our clients.
